3 questionsDo we both have to agree to a divorce?
No. Divorce is now "no fault": one of you can apply alone, and nobody has to blame anyone. It takes at least 26 weeks from the application to the final order.
How much does a divorce cost?
Our fixed fee for an uncontested divorce is $650 plus tax, paid in two parts, plus the court fee of about $600. You know the full cost before we start.
Will we have to go to court?
Very rarely. The divorce itself is done on paper, and most couples settle money and children by agreement or mediation, without ever seeing a judge.
Children
3 questionsWho will the children live with?
There is no automatic rule for mothers or fathers. What matters is what is best for each child, and most parents agree it without a judge. We help you write a plan you can both keep.
Can I move away with the children?
Only with the other parent's agreement or the court's permission. Talk to us first, before you sign a lease or book a school.
Will my children have to choose between us?
No. Older children's wishes are heard, gently, by a trained officer. Nobody asks a child to pick a parent.
Money and the home
3 questionsDo I get half of everything?
Not always. Half is the usual starting point, but needs come first, above all a home for the children. Pensions count too, and are often the biggest thing you own.
Can I stay in the house?
Often, yes, for a time or for good, if the numbers work for both of you. Bring a rough idea of your mortgage and incomes to the free call and we look at it together.
I can't afford a lawyer. What can I do?
Ask about our fixed-fee advice hour ($150), and about legal aid if there has been domestic abuse. If you don't need us, we tell you so.
